INSURANCE COVERAGE FOR MOTOR VEHICLE ACCIDENTS:

The only good news about being injured in an auto accident is that you do not have to pay anything out of pocket for treatment until you have reached the policy limits you paid for when you bought or renewed your policy.  (In Pennsylvania the minimum amount of "bodily injury" coverage is $5,000.)

Pennsylvania is a "No Fault" state.  That means that your motor vehicle insurance pays your doctor bills, no matter who was at fault for the accident.   What surprises many people is that your insurance pays even if you were not the driver of the car.  You could be a passenger in your car or someone else's car or driving someone else's car or a passenger on a bus or a pedestrian or riding your bicycle and get hit by a car.  Here is where it gets really confusing:  If you do not own a car, but a member  of your household does, then his of her insurance company will pay your doctor bills.  If you or nobody in your household owns a car, then you have to go after the other drivers' insurance company to get your doctor bills paid.

Here's a bit of free advice that may help you avoid having financial insult added to your injuries:  For not much money, you can have your "bodily injury" coverage increased to $10,000 or $20,000 or more.  Considering the cost of a trip to an emergency room or trauma center or advanced diagnostic testing such as a MRI, EMG, etc., the $5,000 minimum is not adequate coverage.  Once that's spent, you will have to depend on your medical insurance to cover you and chances are, the coverage won't be as good.

INSURANCE COVERAGE FOR WORKERS' COMPENSATION INJURIES:

There are no out of pocket expenses for treatment of injuries sustained on the job.

All Pennsylvania employers are required to carry Worker's Compensation Insurance or, if they meet strict requirements, be self-insured.  This protects the employer against being sued as well as the worker who will have his or her treatments covered in full and receive direct payments for living expenses while disabled from the injury.

Unlike motor vehicle insurance, there is no policy limit on the amount of money available for treatment.  Like motor vehicle law, Pennsylvania puts limits on the doctor's fee for any given procedure.  The doctor or hospital must accept that fee as payment in full and cannot charge you the difference between their usual fees and the Pennsylvania fee schedule.

Your employer may choose to post a list of at least six doctors.  They must be from different offices or facilities.  If that is the case, you must choose one of them for treatment of your injuries and be under that doctor's care for 90 days.  After 90 days, you can go to any doctor of your choosing. 

According to Pennsylvania case law, if there is no chiropractor on the list posted by your employer, you are free to go to any chiropractor of your choice IMMEDIATELY after your injury.  (This has happened several times with our patients and we have always been paid by the insurance company after furnishing it with the a copy of the judge's ruling in the actual case where this decision was made.)
